TERMS OF SERVICE

TLDR

If a user is to violate any point within my Terms of Service, I am well within my right to take the necessary steps to amend the situation and will take necessary steps to ensure that it does not happen again.

1. Use of my art and characters

This section will correspond to the use of the art which I create, and how the individual may choose to approach or use it.------------- The commissioner, upon the purchase of the art piece, is now the owner of that piece. They are welcome to post the art on their personal or business account, but the post in question must contain some form of credit, be this tagging my account in a post, or naming me. The credit must be present in some form on the post.
- Posting my art to mass art promotion accounts is strictly prohibited, unless with strict written permission from myself. No third parties can vouch for my permission, or say that I have given it in any way.
- Owning a piece of my art is something that cannot be exploited for a user’s monetary gain unless the piece was specifically commissioned that it was for advertisement, or business purposes, and I must be aware if the art is to be used for such, and I must give my strict permission that it can be used for such. Violation with this will not be taken lightly and I will take the steps necessary to remove the infringing advertisement.
- Upon a commission, I am within my right to keep hold of the raw image or artwork produced from the commission and will create appropriate copies to preserve and archive the piece however much is needed.1a. Roleplay
- My art and characters can be used for roleplay, including NSFW roleplay, but it is recommended that you ask me before doing so.
- Do not use my characters in roleplays that involve problematic situations, such as age play, acts of targeted harassment, racism, sexism, homophobia, xenophobia, or any other repulsive or vile action.
- I allow my characters to be used in violent scenes, and you are free to kill my characters, but you may only use my characters during roleplay with my strict given permission.
- You must tell me if you are to use my art or characters in NSFW situations.
- You are not allowed to use my persona in NSFW roleplay scenarios.
- You are not allowed to use any of my minor (under the age of 18) or feral characters in NSFW roleplay of any kind or form. You are not allowed to use any art that features my underage or feral characters in any NFSW roleplay. You must receive strict permission from me if you are to use my underage or feral characters in any SFW roleplay. I will need to know what the roleplay will involve, and I am allowed to revoke your access to those characters at any point.
- Please inform any other parties that are involved or associated with your or their roleplay of these terms of service and send them these terms before any of you begin the roleplay.
- I am able to revoke your access to my art or my characters at any point if your roleplay violates any part of my terms of service.
- If you are unsure if your roleplay violates these terms, please ask me.1b. NSFW
- NSFW art purchased or traded for is owned by the commissioner or the one who owns the character.
- Owning art that contains another’s character/s is still owned by the initial commissioner rather than the additional characters involved.
- Sending any NSFW art or characters that I make to any individual under the age of 18, or sending any NSFW art or characters that I make to servers, group chats, forums, blogs, websites, social media pages, or any other form of distribution to an audience of any size, private or public, where underage individuals can access it is strictly prohibited.
- Do not harass individuals, organisations, private businesses, groups, or any person with my NSFW art.
- Do not use my NSFW art or characters for any malicious means of any kind, on any site.
- Do not use my NSFW art or characters to harass the creator.
- The above points apply to its use online and in real life.

2. Purchasing commissions or art, including trades and requests

This section will correspond to the purchase and gain of art that I create, including trades, requests, Patreon rewards, gifts, or any other form of the gain of my art.-----------2a. Paid Commissions
- During any stage of the payment process, I can revoke and refund your payment if I am not comfortable with your request.
- When converting to Euros, Dollars, RUB, etc… I will use the current conversion rate from Great British Pounds (GBP)
- I can pay through PayPal, Cash App, or direct bank transfer. I will not accept gift cards or in-game currency or other non-monetary payments unless explicitly stated.
- I will tolerate some bartering, but only with people who I trust and am familiar with. Otherwise, my prices will remain and will not change unless otherwise stated. Offers will be politely declined.
- I take payment upfront only. Under specific circumstances in which I cannot begin the initial commission, I can take the payment later. I cannot take the payment in portions, unless given ample reason.
- PayPal fees are accounted for in the price of the commission.
- If my paid commissions are closed, and you are interested in purchasing one in the future, please let me know and you will be placed on my mailing list and will be immediately sent information on the commissions upon their restock.
- Paid commissions are considered high priority, so will be completed before any other form of art acquisition.
- If a commission is not paid, then I will not begin the commission until the appropriate fees are paid.2b. Art trades
- Art trades are a lower priority, so will be completed after all paid commissions are complete.
- Once your part of the art trade is complete, I will aim to complete my part as soon as possible.
- I am the owner of the art made on my part for you until your part of the trade is complete. You will be shown the image, but the full file and rights will not be handed over until your part is complete.
- If my paid commissions are closed, then my trades are likely also closed. However, feel free to message me to check.
- I will supply you with a character, as well as some info on them and their personality. Other than that, you will have complete creative freedom over the pose, etc...2c. Requests
- Requests are the lowest priority, so they will only be completed after any paid commissions and art trades are completed.
- I will have creative freedom over the pose etc. unless otherwise stated.2d. NSFW
- Only individuals over the age of 18 may purchase NSFW commissions or trades.
- If I find out that you are not over the age of 18 and you have purchased a NSFW commission, your rights to the image will be revoked and you will be given a full refund.
- If more than one individual is to be drawn, you must show me or they must contact me to confirm their consent to be included in this piece. If this does not happen, I will refuse your commission.
- All characters included in the piece must be over the age of 18. I will refuse your commission if you do not comply, and will report your account if necessary.
- I will not draw spiteful, hateful, demeaning, or discriminative pieces targeted towards any individual, group, organisation, religion, race, sexuality, gender, identity, or anything else similar.
- I will not draw feral characters (animals, who are not bipedal humanised furries) in any form of sexual or suggestive situation. I will refuse your commission if you do not comply, and I will report your account if necessary.
- I will not draw real-life people, unless given explicit consent from the parties involved.
- I can draw various kinks, but please inform me of what you would like, and I will judge if I am comfortable drawing it.
- I have full right to deny, cancel your order, or report you if necessary.2e. Gore & graphic violence
- I am comfortable drawing gore.
- I will not draw underage or feral characters in graphic situations.
- Please specify what you would like drawn (e.g. blood volume, injuries afflicted, situation, etc…), else I can take creative freedom
- I will only draw other’s characters if I am given explicit consent by the owner.
- I will not draw spiteful, hateful, demeaning, or discriminative pieces targeted towards any individual, group, organisation, religion, race, sexuality, gender, identity, or anything else similar.
- I have full right to deny, cancel your order, or report you if necessary.

3. Purchasing or trading characters

This section will correspond to the purchase or trade of characters and designs of mine. This includes characters that I own, characters that I have created and designed, and characters that I have bought/traded for, plus any characters that I own at the time of the trade. This also covers the trade and use of my characters, and how they are traded or sold in the aftermarket.------------ All of my characters and designs are under my copyright (SplitFox, 2018 ©). Violation of this copyright will result in me or those I trust taking the necessary steps to protect this copyright. Violating this infringes the UK Copyright, Designs and Patents Act 1988.
- Upon the acquisition of one of my designs or characters, you now own that specific character. The design is still under my ownership, and you cannot claim credit for the design under any circumstance.
- You are not to claim the design as your own under any circumstances or situation. Violation of this will need to be taken up with site officials, or have your character removed from your custody.
- As the character/s is now within your possession, you now have full reign over what you can do with them. However, you may not use my designs to participate in harmful, discriminative, or any other kind of cruel or crude works, or use their likeness to present harmful views, ideologies, beliefs, messages, or anything similar. Violation of this will result in your character being seized, and you will be reported if necessary.
- You may draw or acquire NSFW/NSFL work of the acquired character, but only if the character is over the age of 18 and follows the rules I outlined relating to NSFW/NSFL in sections 1b, 2d, 2e.3a. Reselling
- If you do plan to resell or retrade or redistribute my design or character, please inform me beforehand. I am well within my right to deny this transaction, as well as to repossess the character if I feel that it is not going to a good home.
- If your character is taken off you without your consent or not paid for, please inform me and I will do my best to return the character to you.
- If you need assistance in valuing your character, please contact me and I can supply you with an adequate and accurate price.

4. Commercial use of my art or characters

This section will correspond to the commercial use of my characters. This includes marketing use, advertisement, promotions, and other similar and different forms of using my art for monetary gain.------------ Posting my art or characters or designs to mass art promotion accounts is strictly prohibited, unless with strict written permission from myself. No third parties can vouch for my permission or say that I have given it in any way.
- Owning a piece of my art, character, or design is something that cannot be exploited for a user’s monetary gain unless the piece was specifically commissioned that it was for advertisement, or business purposes, and I must be aware if the art is to be used for such, and I must give my strict permission that it can be used for such. Violation of this will not be taken lightly and I will take the steps necessary to remove the infringing advertisement.
- Under no circumstances will I ever use my art as an NFT or for any form of cryptocurrency. If I find that my art has been used for so, I will take the necessary legal action to preserve my creative rights.
- I need to receive full credit for the creation of the art, character, or likeness.4a. Paid advertisement
- If my art or characters or their likeness is to be used in commercial advertising, it must be first brought to my attention by the company owner or marketing team that this is what the art is to be used for. Unauthorized use of my art in any form advertisement is strictly prohibited.
- I should be made aware of what the advertisement is for, its purposes, and its intended audience.
- I am well within my right to not allow my art, characters, or likenesses to be used in any form of commercial advertisement and will take the necessary steps to regain possession of said property or, if necessary, get the advertisement revoked.
- I need to receive full credit for the creation of the art, character, or likeness.4b. non-paid advertisement
- This term encapsulates advertisement not paid for by a marketing campaign. This includes use on commission sheets (and similar things) to add appeal or decoration or otherwise, use on one’s page to direct attention to one’s page or other. Etc.
- I will need to be alerted to what the art, design, character, or likeness will be used for.
- I am well within my right to not allow my art, characters, or likenesses to be used in any form of advertisement and will take the necessary steps to regain possession of said property or, if necessary, get the advertisement revoked.
- I need to receive full credit for the creation of the art, character, or likeness.

5. Reproduction of my art or characters

This section will correspond to my character's likeness, any attempt to reproduce my characters or their likeness, taking inspiration from my characters or their likeness, and my ownership and rights over their designs.- Under no circumstances can you trace or copy my art. I will always take the necessary steps to preserve my art and will have the art removed.
- Under no circumstances can you trace or copy my character designs or characters. I will always take the necessary steps to preserve my art and will have the art removed.5a. Duplication
- Explicit duplication of my characters is strictly prohibited. Any attempts to duplicate my characters and claim their design as your own, your own creation, or any other form of credit unrelating to my original creation is strictly prohibited and I will take the steps necessary to reclaim ownership. This applies to: the complete 1:1 copy of my character/s, likeness, and story; the duplication of everything to do with my character/s, but with a different/altered name or facets of their story; the complete 1:1 copy of their story, but applied to a different design; and any other form of duplication stemming from my character/s.
- Explicit duplication of the design of my character. This includes the theft of their actual art or designs, or the entire character itself.
- In order for duplication to be filed for, there needs to be enough of a noticeable similarity for similar or identical traits, features, stories, facets, etc. I will need to confirm myself if I can see that a likeness is present, otherwise the character will not be removed at that time. If a similarity is noticed in the future, then steps will be taken.5b. Inspiration
- I am happy for minor inspirations to be taken, e.g. I create a feline character, and someone else is hence inspired to create a feline. However, if it occurs too often with the same creator/s, then suspicions will be raised.
- I am tentative around major inspirations to take an entire colour palette e.g. say one of my characters has a colour palette of 12 specific shades of blue and aquamarine, and this exact palette is duplicated without alteration.
- I do not allow inspiration that is so heavy that it can be considered duplication, or is so convenient it cannot be a coincidence.
- This applies to my art also. Scenarios that are nearly identical in nature e.g. an angel character poised in a specific contortionist pose while standing on a serving platter, where the pose and scenario have been inspired to such a degree it is overly coincidental.
- If heavy inspiration has been taken, I will communicate with the artist/s in question and take the steps necessary to protect my creative properties.

I do not allow for the theft, duplication, copying, tracing, heavy inspiration, reproduction, use in marketing or advertisement, sexualisation of minor or feral characters, or the breaking of any of these terms of service in relation to my art, characters, designs, writing, and creations in general.
